But they weren't arrested off the streets of New York, Doubtingthomas. They were taken off the battle field. If anything, they would be POW's. Habeas Corpus doesn't apply to POW's. Incidently, that's also why this situation is so problematic, because while they're closer to POW's than to arrested civilians, they don't quite fit into THAT category either. Habeas Corpus still doesn't apply, but what DOES apply is up to debate.
Point taken.
But before you say they are POWs. What war and what battle field where they taken from. No declaration of war was ever signed so no war ever existed. If they are from Iraq they should be treated as POWs in the Iraq war and released when that war is over.
Because the people may want to kill us, or even have detailed plains to kill us. Does not give us the right to detain them indefinatly.
You need to say they are POWs or Civilians. You need someone familiar with international law address these questions. And this needs to be done in a non-bias international court. No matter what thier status... Habaus Corpus applys...because its not just a american right. All around the world people have the right to ask thier jailer "why and for how long" they will be imprisioned.
To do any different would make these people slaves to thier captors and not people.
You can't simply say they don't apply because thats having your cake and eating it too.
