Sorry to hear that but I would be more suprised if the guy told the truth and/or the insurance company offered to pay for anything.

Any nearby diety have mercy on the fool who does something like that to a member of my family. My relatives are the kind who would, no joke, get really really drunk and burn the guys house down. You know anyone like that?

Did he hit from behind or hit her on the side? I mean if he scraped the side of the car that alone says that he attempted an over taking manouver, which in my view means its irrelevent whether her indicaters where on or off at the time. If he hit the car from behind I'm not sure how that works in the US but usually the person who went into the back of the car in fronts insurrance company pays.

These are only my opinions though, to me its a clear case.

I agree with you and was confused by this - to me, whether her indicators were on or off makes no difference. In Australia this would be a clear cut case of neg driving since examination of both vehicles would make it pretty clear that he hit her.

Maybe that's how you work in Sydney, but in Victoria, hitting the back of their car with the front of yours, even if it was because they backed out of their driveway too quickly, leaves you being deemed as the cause.
