What was his prior record? I thought the judge gave out the sentence - s/he would consider past behaviour to determine what sort of sentence to give.

In most states introducing past acts to the jury is not allowed!
But this is Texas!
Juries decide the sentences in most cases today!

It looks like Texas has the "3 Strikes and Your Out" system.
In some states, repeat offenders get the book launched at them!
In S.C., If you are a habitual offender(driving), your driving privileges get permanently revoked.Same type of deal.
Repeatedly break the law,and pay some serious consequences.

I don't know if it has been established in Texas! But Texas is famous for launching said book!

Kampa, the jury can recommend a sentence, but the Judge has the ultimate say so.
There have been cases that the jury recommended death for a murderer, but the Judge instead gave the murderer so much time, that the convict never would see the outside again.

I concede that but it is rare for a judge to contrevene the decisions of juries.
