A Texas lawmaker is proposing a bill that would allow gun makers in Texas to stamp "Made in Texas" onto firearms they produce, thus freeing those firearms from federal regulations.

The federal government, according to this lawmaker, uses the interstate commerce clause to regulate guns in Texas through several federal bills. The law would exempt Made in Texas guns from all federal laws.

Which regulations specifically is he trying to avoid?

What are the federal guidelines?

And how exactly would they be able to prevent any of those firearms from leaving the state?

That's not really possible I would think.

So the new proposed law is aimed at avoiding the majority of the regulations that were imposed in the GCA?

And give more rights to the mom and pop shops to distribute their own firearms.

Montana already passed the same type of law last month

At any rate, it won't work because federal laws always supercede state laws in the event of a conflict. If a "test case" goes to court, that will be the conclusion. Just like how medical marijuana shops in California were getting shut down by federal agents even though they complied with state law.

This is true, but economic and trade laws are based on interstate commerce. If the guns are only manufactured and sold in Texas, interstate commerce laws would not apply.

And the moment one of them shows up in Arizona, or Oklahoma, or Mexico.. game over.

There's no way to keep them strictly in Texas.

Exactly, it's inevitable that some will leave the state, how will they deal with that? Besides, what about federal background checks, does avoiding regulation mean any maniac can buy a gun whenever they want? I don't think even texans want that, even if it does mean lower taxes.

I am pretty sure it said that it wanted to avoid the background checks as well.

That would exempt them from federal gun registration, dealer licensing rules and buyer background checks. State laws would still apply.

Why would you want to avoid background checks?? they are put in place for a reason!!
Yah I know it's easy to get contraband guns so background check policies mean squat.

Not if the law is unconstitutional. That appears to be the idea.

Let Texas just becoem their own country like they've always wanted and be done with it. Then we won't have to keep sending them all kinds of money for their natural disasters.
