Why is this not considered a hate crime?

A good question, but before I start, perhaps I should offer a tip.... It's not too wise to take the Daily Mail in Britain seriously. This is a hard line, right wing newspaper with a complex against muslims, gays, pro-abortionists, the welfare state and anything that isn't white, middle class, Christian and "patriotic".

Most Britons know it as the voice of "Little Englanders".... those individuals who still think that an Englishman's home is his castle and the country's been going to the dogs ever since the Empire collapsed.

But getting back to your point: Hate crime is hate crime, no matter who does it or in pursuance of whatever cause.

The difficulty in identifying it lies in the motivation behind any particular act. It's one thing to punch somebody on the nose, but why do it..? If somebody is drunk and gets into an altercation over another person trying to grab the last taxi at the rank, and it turns out that the guy pushing in is gay, then the gay guy getting a bloody nose didn't get it because he was gay, he got it because he tried to jump the queue. That is not hate crime, it's simple civil disorder.

However, if he is set upon by a gang of hooligans as he comes out of a nightclub holding his boyfriend's hand and the youths decide to indulge in a spot of "Queer Bashing", then he was attacked solely because of his homosexuality. That is a hate crime.

It's all a matter of identifying motivation and that can often be the reason why such discrimination goes unchecked.

For instance..... Religionists attempt to claim that their persecution of gays is a matter of "Religious Conscience"..... an example may be the guest house owners who won't allow homosexuals to stay in their premises for no other reason than the fact that they are gay. That is clear discrimination, but the owners will play the "religious conviction" card in an (increasingly futile) attempt to justify or legitimise their act.

Defining what is a hate crime, and proving motivation is the trick, and it's not easy to prosecute because the burden of proof lies with the accuser. The law (quite rightly) demands very high standards of evidence, but how do you prove somebody's motivation for doing something, if it is entirely down to their mental attitude..? Not easy, is it..?

We can't read other people's minds.

Hate crime is what it is and we can put all sorts of legal criteria in place to define what constitutes it, and in what circumstances it may apply. But people are people and they will use all sorts of arguments to negate the accusation. That's why it is so difficult to prosecute.

the problem with blanket discrimination is it can also be applied to every news story which eminates from a particular publication ... in this case ... the daily mail .. this paper is frowned upon by... lets say...the more thoughtful members of society ...and all stories it publishes tend to be branded as spurious ..however , the story about young white girls being targeted is a true story ... and a few years before ..one of the documentary shows .. either horizon or panarama were going to put out a programme which exposed this very story ... how muslim gangs were targetting white girls and coercing them to prostitute themselves ..however, the timing of the programme was thought insensitive ...because a local election was taking place in that locale at the time and the police asked the tv people not to show it because it would cause unrest and maybe even violence ..which in turn would affect the elections ... they pulled it and showed it much later ...

Must be an English thing... There is nothing particularly derogatory in an Aussie calling someone from Pakistan a Paki. We call the English Poms or Brits, Americans yanks or seppos (short for 'Septic Tanks' ) etc. If we can shorten a word we will
