Employment Law... Need some advice..

Theres a slight Issue in my office. And its ever increasing. The Boss has not addressed the amount of sick days, tardiness and the lack of training given. (some days i can put my hand up for all three).

Yesterday he pulled a girl into the office and said that she has to leave at the end of the week. His reason was she had taken to many sick days. Which in all fairness she did. BUT she was Never was warned when she went over. Also the issus of training. Over half the people here really dont know whats going on or what there doing. There hundred of things i could get into about this.

Can anyone help...??

Adequate training must be given to enable you to do your job to the required standard.

Warnings must be given before sackings.

YOu cant sack someone for taking time off sick, legally it is for the employer to offer help if someone is recurrently ill. This should be referred to an Occupational Health physician.

As bandy said, there is a legal proceedure of written warnings before someone can be sacked.

Cheers treeb. Im going to repersent the people in question. I think one of them is bringing a solicitor if it carries on. Nothing is in writing.. no warnings given nothing!

Solicitors are pricy, Citizens Advice are very good at this stuff and the Department of Employment are also very helpful.

well they would be helpful, less people signing on that way

The Boss is leaving himself wide open to a legal proceedings.

There must be a procedure (written) in any workplace to govern what is acceptable behaviour and what is seen to be the required level of efficiency.

If this girl is being let go because she is inefficient he has to be able to back up that fact by having details of the training she received to attain efficiency, remedial training put in place to rectify any shortcomings following the discovery that she was not effective. At all stages the employee must be advised that her performance is not acceptable. Verbaly and followed up in writing as the case becomes more serious.

I have had to let staff go who had poor attendance. They weren't sacked for their sick record they were sacked for being inefficient.

It takes a lot of time to go throught the process and an employer has to prove that everything possible was done to try and rectify the problem.

Your boss is cutting a sick to beat himself with. May be advisable to have a quiet word if they are open to advice.

I thought this was the situation. I will do that, i think he needs to be told. And i may even put it in writing aswell.

I've just been to a meeting and advised that due to budget constraints it would appear that I am to loose 5 of my casual staff.

This coming from that nutter who blew thousands from last years budget on a TV and fcuking plants.

I'm waiting on confirmation before I take the youngsters in and tell them they leave possibily as soon as the end of THIS week.

f***! thats not right... i think you should go over her head and show your concerns...

Just chatting to an engineer i employed and i happen to mention about this situation. he said that the problem with managers, there is no offical training. I know there is a course all managers in aircraft engineer have to go throw and they have to have a minimum of a HNC in engineering to be concidered. But in retail, recruitment etc a manger is a person that didnt take a sick day and arsed kissed t the top.. result... poor mangement.. that woman buying those plants could have paid for those casuals till the next budget... then if there wasnt enough we would all under stand why they have to go...
