Remember Amanda Knox? She is an American citizen who was on trial for murder in Italy. She was acquitted and came home to Seattle to be with her family 18 months ago. Well now the Italian courts have reversed the acquittal and ordered a new trial for Amanda. She may face extradition to Italy. In America this would be called double jeopardy, and would be not allowed to happen.

I think that regardless of what was happened, the Italian government let her go, and they shouldn't be able to retry after she was acquitted.

I don't see anything coming of it. If the Italian government tries to bring her back, it will ultimately be up to the U.S. government. I don't see our government doing that.

What gets me about the article is the "The U.S. and Italy could come to a deal to keep her in the U.S." part. What kind of deal? Surely we can't imprison her here for a crime committed (possibly) there. So what...?

Well their system is different, but to try to make a comparison...or explain...

She wasn't found innocent in the trial. She was found guilty, THEN LATER the trial decision was overturned on appeal due to "technicalities".

So, it is not like a "double jeopardy" in the USA... it is not a situation where a person is found innocent and is being tried a second time for the same crime.

The 1st trial was over turned sort of like a mistrial, and the case is being sent back by way of the appeals court processes to correct the problems in the original trial (in which she was actually found guilty).

This actually happens in our court system periodically also.

Apparently, the Italian government does not have a law against double jeopardy. A new trial has been ordered for Amanda. Even if she is not extradited back to Italy, she could be tried in court in Italy while she is still living in America.

In America defendants are either found Guilty or Not Guilty. Defendants are never legally found "innocent".

AND she was not found "innocent" in Italy either.

For once Wikipedia might help....
"...in 2009. She served four years of a 26-year sentence before the murder conviction was overturned on October 3, 2011. However, on March 26, 2013, Knox's acquittal was overturned by the Italian Supreme Court , sending the case back to the lower court for reconsideration."

I agree with Chaski. If the case was overturned, they have the right and opportunity to reopen the case and take it to trial. Its not double jeopardy since there was no guilty/not guilty verdict.

Its like in America if the judge dismisses the case due to not enough evidence, etc. They can reopen it and bring it to court if they have more evidence.

We have some agreements in place (treaties I think) and also "status of forces agreements" as our military has bases in Italy. However, both sides have gone against them periodically.

For example (if memory serves) the Italians have asked for certain "agents" involved in our terrorist rendition/interrogation program to be sent to Italy for questioning and/or prosecution.

We have so far refused.

There were a few times (again if memory serves) when we asked the Italians for certain Mafia types... but they have not always complied.
