Can anyone please tell me if BAH is calculated into income for child support reasons? My exhusband just got mobilized and he's telling me that I "cant touch his BAH." I was under the impression that BAH is for the dependents! He is telling me that I am only allowed to use his base pay for imputing child support.

I think its Basic Allowance for Housing paid for by the Army and I believe that Child Support would take it into account although it would have to be regular payments I believe.

I have been through this personally in court. It 1 depends on the state you live in and 2 is up to the judge. Since the government doesn't even consider this as earned income it is hard to do. The military calculates the BAH by where you live and that is why they get it to begin with. It is not free housing or does it cover all the bills for housing which is a common misconception. Say you live in a small town stationed in like Oklahoma and then get stationed in say Japan. The cost of living is extremely different there and since you do not get paid more for living there as in take home pay they try to make up some of the difference with cola and bah. Does you husband pay child support now? I personally do not think it is right to do this to military after learning all about it. But then again I do not know your situation and am a mom myself. Their dad is military and takes very good care of them.
