Did you read the terms of your "purchase agreement"? What does it say? Why does the developer want to go to court? If their intent is to take your deposit and move on (according to Bulgarian laws and your purchase agreement), and you have not brought the remaining funds to the table to close the deal, within the allotted time, you just may be out of luck...
But, only you (should) know the outcome, based upon whatever is in your "purchase agreement."
